Terms & Conditions
Last updated: 18 August 2026
Welcome to www.marsdensfudge.co.uk. These terms and conditions set out the rules that apply whenever you browse our site or place an order with us. By using this website or buying our fudge, you're agreeing to them, so please take a few minutes to read through before you check out. If anything here is unclear, get in touch and we'll happily explain.
1. Who We Are
This website is operated by Marsdens Confectionery Co Ltd, a company registered in England and Wales under company number 14326012. Our registered office is at Unit 2, Uffcot Farm, Wilts SN4 9NB. Our fudge is made and dispatched from 10 Bradley Close, Kintbury, Nr Hungerford, Berkshire, RG17 9UJ.
Throughout these terms, "we", "us" and "our" refer to Marsdens Confectionery Co Ltd, and "you" refers to the customer placing an order or browsing the site.
2. Our Products
Every batch of Marsdens fudge is made by hand in small quantities, so you may notice slight variation in colour, shape, weight or texture from one batch to the next — this is simply a feature of handmade confectionery and not a fault. We do our best to make sure photographs and descriptions on the site are accurate, but they're intended as a guide and shouldn't be treated as an exact representation of the product you receive.
Because we make in small batches, occasionally a flavour or product may be temporarily out of stock. If that happens after you've placed an order, we'll contact you to offer a substitute, a delay, or a full refund for that item.
3. Placing an Order
You must be at least 18 years old and legally able to enter into a contract to order from us. When you place an order, we'll send you an acknowledgement by email, but this doesn't mean your order has been accepted — the contract between us is only formed once we send a separate confirmation that your order has been dispatched. Until that point, we're free to decline or cancel an order (for example, if an item turns out to be unavailable or there's been a pricing error), and we'll let you know straight away and refund any payment already taken.
4. Prices & Payment
All prices shown on the site are in pounds sterling and include VAT where applicable. Delivery charges are shown separately at checkout before you complete your order. We take reasonable care to keep pricing accurate, but if we discover a genuine pricing error after you've ordered, we'll contact you before dispatching to confirm whether you'd like to proceed at the correct price or cancel.
Payment is taken securely through our checkout at the time you place your order, using the payment methods offered on the site.
5. Delivery
We aim to dispatch orders promptly and will always try to get your fudge to you as fresh as possible. Estimated delivery times are shown at checkout, but these are estimates rather than guarantees, and occasionally things beyond our control (courier delays, severe weather, and so on) can push delivery back. If we don't think we can get an order to you within 30 days of the date you ordered, we'll get in touch to agree a new delivery date or offer a refund.
Risk in the goods passes to you once they've been delivered to the address you provided, so please make sure your delivery details are correct when you order.
6. Your Right to Cancel
As a consumer, you have a legal right to change your mind and cancel your order within 14 days of receiving it, without giving a reason, under the Consumer Contracts Regulations. To cancel, just email us at alex@marsdensfudge.co.uk or call us on 01488 608530 to let us know.
Please note that because fudge is a sealed food product, this cancellation right doesn't apply once packaging has been opened, for health and hygiene reasons — unless the product is faulty or not as described (see section 8 below).
7. Returns, Exchanges & Refunds
Full details of our returns process are set out on our Returns page, and the key points are summarised here:
- You have 14 days from the date of purchase to request a return — after that, we're unable to offer a refund or exchange.
- Items must be unused, unopened and returned in their original packaging, along with your receipt or proof of purchase. Sale items are excluded from returns.
- Once we've received and inspected your return, we'll email you to confirm whether the refund has been approved. Approved refunds are issued back to your original payment method; please allow a few days for this to show on your statement, and if it hasn't after a reasonable time, contact your card provider before getting in touch with us.
- Return postage is your responsibility and isn't refundable. For anything over £50 in value, we'd recommend using a tracked service, as we can't guarantee we'll receive items sent back to us.
- Only faulty or damaged items are eligible for a straight exchange. To arrange one, email alex@marsdensfudge.co.uk and post the item to Marsdens Confectionery, 10 Bradley Close, Kintbury, RG17 9UJ.
- If you received something as a labelled gift, you'll be offered a gift certificate rather than a refund to the buyer. Gifts that weren't marked as such when ordered will be refunded to the original purchaser.
8. Faulty, Damaged or Incorrect Items
If your order arrives damaged, faulty, or isn't what you ordered, please contact us as soon as possible at alex@marsdensfudge.co.uk with a photo where you can, and we'll sort out a replacement or refund. This is in addition to, and doesn't affect, your statutory rights under the Consumer Rights Act 2015, which require goods to be of satisfactory quality, fit for purpose, and as described.
9. Allergens & Storage
Our fudge is handmade in a kitchen that also handles nuts, dairy, gluten and other allergens, so traces may be present in any product even where not listed as an ingredient. Full allergen information is provided on product packaging and listings — if you have a food allergy or intolerance, please check this carefully before ordering, or contact us if you're unsure. We'd recommend storing fudge in a cool, dry place and consuming it by the best-before date shown on the packaging.
10. Intellectual Property
All content on this website, including our logo, product photography, recipes and text, belongs to Marsdens Confectionery Co Ltd or our licensors and is protected by copyright. You're welcome to share links to our site, but please don't copy or reuse our content commercially without asking us first.
11. Privacy
We only use your personal information to process your order, manage your account, and (where you've agreed to it) keep you updated with news and offers. We handle your data in line with UK GDPR and never sell your details to third parties. For more detail on how we collect and use your information, see our Privacy Policy.
12. Governing Law & Complaints
These terms are governed by the law of England and Wales, and any disputes will be dealt with by the courts of England and Wales. If you're not happy with something, please contact us first — we aim to acknowledge complaints within a few working days and resolve them as quickly as we can.
13. Changes to These Terms
We may update these terms from time to time, for example to reflect changes in the law or how we run our business. The version in force will always be the one published on this page, so it's worth checking back occasionally. Changes won't affect orders you've already placed.
